Understanding Your Immigration Rights in the U.S.

Although the first two months of the Trump presidency have been filled with confusion and unpredictability, and even hostility toward immigrant communities, one thing is certain - now more than ever it is important to know your rights. Everyone living in the United States has certain rights protected under the United States Constitution, including undocumented immigrants.

The American Immigration Lawyers Association (AILA) is an organization committed to helping immigrants. The attorneys at Milla & Associates, LLC are experienced immigration attorneys and members of AILA, providing comprehensive immigration services, including removal (“deportation”) defense, Deferred Action for Childhood Arrivals (DACA), asylum, U visas, provisional waivers and other hardship waivers, applications for permanent resident status (“green card”), and citizenship.

AILA has created “Know Your Rights” flyers to provide crucial information in the event of an encounter with ICE officers at home, at work, or in a public place. We understand how frightening the thought of an encounter with ICE can be, not to mention an actual encounter. Therefore, it is very important to know how to handle such a situation before it happens.

You do have rights. Please print and read the AILA flyers, and contact Milla & Associates if you want to learn more about your rights and possible eligibility for immigration benefits and relief.

Understanding the Provisional Waiver for Unlawful Presence

March 4, 2013 marked the first day that immigrant visa applicants could file provisional waivers for unlawful presence. Under the prior procedure, individuals had to leave the U.S. before applying for the waiver, thus living abroad (and likely apart) from U.S. citizen family. Although the process just started in March, and we are waiting to see how the system is fully implemented, there is cause for optimism.

  • Fantastic, down to earth legal counsel who gets the job done!

“After meeting with multiple lawyers, many of whom seemed not to care about the outcome of our case, or left us feeling confused about the process, we finally found Robert. After my initial consultation with him, I left feeling hopeful and assured of the process. My husband is from England, and we had faced many long months apart. With Robert's help, we were finally able to start the process to bring him to the United States. Robert and Daniel were incredibly helpful every step of the way, and never made us feel silly for asking questions. Robert clearly outlined the process for us, so we knew exactly what was happening at each step. Our paperwork was completed in a very timely manner. Incredibly, we had a very short wait for our interview and at that time, Daniel and Robert made sure we were prepared. Robert is extremely trustworthy and tells you exactly how it is, which is so refreshing after being yanked around by other lawyers. My husband received his Legal Permanent Resident card in the mail the other day, and we could not be happier! THANK YOU to Robert and his team for their help! We are so grateful!”

  • Thanks to Robert’s expertise, we are very happy campers now, ...

“We were referred to Mr. Milla by our previous attorney, who felt that our case had ‘hit the wall.’ In our opinion, R. Milla was the best thing that happened to our case! After over three years filled with nothing but frustration, we’ve asked for Robert’s help. Our case was based on marriage to US citizen and had some roadblocks along the way, but thanks to Robert’s expertise, we are very happy campers now, planning our first vacation abroad!”

  • Personal immigration lawyer

“Justin is my goto immigration lawyer. I came here as a student and Justin handled my H1B case couple of years ago. Although Trump administration was pushing back on many of the cases with RFEs, Justin gave a strongly worded response back and got me, my H1B. Last year, fortunately I met my now wife and after we got married, Justin handled our green card processing with ease and seamlessly. He has many contacts in the Immigration office, which made even more easier and hospitable for my interview. He was available throughout the interview and even helped on a couple difficult questions in between the interview. Throughout the processing, I found Justin highly organized and great understanding of the domain. He is very current with the news and changes to immigration laws and if he doesn't have answer then, you can expect an email to follow up with answers. I highly recommend Justin as a personal immigration lawyer.”

  • Complicated N400 case!

“I found Milla & Associates through Avvo as he had great ratings and reviews by previous clients. I had a fairly complicated case of immigration for naturalization N400) through a spouse as I had been out of the country for very large chunks of time. Robert was an excellent guide in terms of how to approach the case and what documents to include/exclude in order to make my case stronger. He was thorough with his research and very well acquainted with the whole process. Despite my super complicated case, he put it forward in such a way that it was a smooth approval. He made our immigration journey stress free and having him next to me at my interview made me feel confident since he is very competent! I highly highly recommend him for any immigration law cases”

  • Robert helped us file the waiver and it was approved today

“My husband and I had a very complicated I601 and I212 waiver case and had to hire an attorney no matter what. With Robert’s guidance and expertise we were able to put together a very strong argument as to why my husband couldn’t live in Costa Rica and why he needed me with him. Robert helped us file the waiver and it was approved today, November 21st 2013!!!”

  • Robert has been absolutely amazing!

“Robert has been absolutely amazing! My husband and I used his services for our marriage based green card application. Our case was not complicated, but we are so happy we hired Robert. He was nothing but helpful and would always make time to schedule a meeting with us or jump on the phone to guide us through the process and answer our (many) questions. On top of him being friendly and approachable, he knows the immigration law inside out. We can not recommend Robert enough to anyone applying for a marriage based permanent residence.”
