EB-2 Advanced Degree Visa
The EB-2 visa for advanced degree professionals is considered a good alternative for qualified foreign individuals who apply for EB-1 immigration and have fallen short.
Requirements:
A master's degree in science or the arts (M.S. or M.A.), a master's degree in business administration (M.B.A.), or a law degree based on the advancement of science or the arts is required of qualified visa candidates in this category.
An applicant does not need to show any specific number of years of experience to prove eligibility for the EB-2 visa, although they typically do so. However, applicants for the EB-2 visa in this category do need to have a job offer in the United States and prove that they possess an advanced degree or an advanced degree equivalent, qualifying for one of the EB-2 job-exception categories related to the United States labor market and the EB green card process. The position must also meet the Labor Certification Program requirements.
Employment-based second preference immigrant visa applicants do not need to complete labor certification if the Department of Labor finds the following specific circumstances, the job is located in a “shortage occupation,” or the applicant has a valid U.S. advance degree or an equivalent and is paid at least the minimum prevailing wage. If there applicant is working in an underserved area, then they may qualify for a National Interest Waiver (NIW).
